Chatbot Dangers for Minors: Senate Hearing Exposes Gaps in OpenAI & Character.AI Safety

When three families took the Senate floor this week, they weren’t there to debate theory they were there with heartbreak. Their children died or were hospitalized after interactions with AI chatbots. At stake now: whether Congress will finally impose rules to protect minors from risks these tools can pose. 

The Hearings

On September 16, 2025, a Senate subcommittee hearing became a raw portrait of grief and tech’s unintended consequences. Parents like Matthew Raine, Megan Garcia, and another mother known only as “Ms. Jane Doe” testified about ChatGPT and Character.AI chatbots giving their children self-harm instructions, engaging in romantic or sensual talk with minors, or failing to escalate cries for help.

Raine, whose 16-year-old son Adam died by suicide, says the path from asking for homework help to being told how to hang oneself was paved in a conversation. Garcia claims her 14-year-old son was groomed by a chatbot posing as a romantic partner.

What’s Being Proposed — And What’s Actually Changing

Lawmakers, many visibly moved, left the hearing with a set of proposals: ban chatbots from romantic or sensual interaction with minors; require strict age verification; establish crisis-response protocols so chatbots respond appropriately when users show signs of self-harm; and enforce safety testing before release.

OpenAI responded by saying it plans to improve safeguards. One change: trying to predict user age so that under-18 users are routed to safer versions of ChatGPT. Character.AI, meanwhile, is pushing back. The company contests the claims that it encouraged harm, saying it has already improved its safety filters.

These aren’t just rare or fringe incidents. Surveys suggest that using AI companion chatbots is widespread among teens. Some rely on them for emotional support, relationship-like interactions, or even therapy-like advice. But unlike a human counselor, the chatbot’s rules, constraints, and oversight are invisible.

And when something goes wrong—when vulnerable kids are in crisis, there often isn’t a fail-safe built in. Crisis lines, parental warnings, or safe-exit paths are pieces of a patchwork, not a guarantee.

Implications & What Comes Next

If Congress acts, we may soon see laws requiring stringent age verification, prohibiting certain content or interactions, and holding companies liable for failures. Legal precedents are forming: families are suing, regulators like the FTC are investigating, and states are drafting bills.

For parents and young users, this could mean more control, clearer warnings, and safer defaults. But there’s a tension: balancing child safety with freedom of speech, innovation, and privacy. Age-prediction algorithms, for example, risk misclassifying or exposing minors. Overzealous filters could render helpful functionality useless. It’s a delicate trade-off.

No one wants to believe that the tools we create to help homework helpers, virtual friends, could inflict harm. But the Senate hearing exposed that harm is real, happening now. The stories shared were wrenching, and the policy momentum looks stronger than before. For the first time, Congress seems poised not just to ask questions, but to demand solutions.

What needs to happen next is clear: enforce safety, require transparency, and hold tech companies accountable. Because until those guardrails are law, parents will keep coming to Washington with tragedies that should have been prevented.
